Terms of use
Short, and written to be read. Installing or using Awake means you accept these terms.
1. Your licence to use Awake
Yasin Walum grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Awake on devices you own or control, for your own use. Awake 1.0.0 is free of charge and contains no ads and no in-app purchases.
The app, its name, its artwork and its code remain the property of the developer. You may not resell it, sublicense it, or redistribute a modified build of it as your own. Nothing here overrides the terms of any open source components the app includes, which keep their own licences.
2. Awake is not a safety-critical device
Read this one properly
Awake is not a safety-critical system and it is not a medical device. Do not rely on it in any situation where failing to wake up, or waking up late, could cause injury, loss, or harm to you or to anyone else.
That includes, and is not limited to: medication schedules, medical appointments, driving or operating machinery, shift work with safety responsibilities, childcare, caring for a dependent person, and any professional on-call duty.
An alarm on a general-purpose phone can fail for reasons entirely outside the app's control: the battery goes flat, the phone is switched off or restarted mid-cycle, the operating system kills the app to save power, an Android update revokes a permission, the volume is muted, a hardware fault occurs, or you dismiss the alarm and go back to sleep. If missing a wake-up matters, use a dedicated alarm clock, or more than one independent alarm.
Awake makes no claim to diagnose, treat, cure or prevent any condition, including any sleep disorder. It does not provide medical, health or fitness advice.
3. Physical activity challenges
The push-up, jump and walk challenges ask you to move, sometimes within seconds of waking, when you are least coordinated and least alert. You take part at your own risk.
- Consult a doctor before using the exercise challenges if you have any injury, cardiovascular condition, joint or back problem, balance or mobility difficulty, if you are pregnant, or if you are otherwise unsure whether sudden exercise is safe for you.
- Clear the space around you first. Stop immediately if you feel pain, dizziness, faintness or shortness of breath.
- Rep and step counting is inferred from sensors and is approximate. It is not a fitness measurement, and it should not be treated as one.
- The emergency dismiss, a five second long press, is always available and requires no physical activity.
The developer accepts no liability for injury arising from performing these challenges.
4. No warranty
Awake is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, to the fullest extent permitted by law. That includes any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
The developer does not warrant that the app will be uninterrupted, error-free, or that any alarm will ring at the intended time on your particular device and Android build.
5. Limitation of liability
To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, income, data, opportunity, or goodwill, arising out of or connected with your use of Awake, including any missed wake-up or missed appointment.
Where liability cannot lawfully be excluded, it is limited to the amount you paid for the app, which for version 1.0.0 is zero.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights under the law of your country of residence are not affected by anything in this document.
6. Acceptable use
Do not use Awake to harass or endanger anyone, do not attempt to defeat the security of the device or the app, and do not use it in breach of any law that applies to you.
7. Changes and availability
Awake may be updated, changed or withdrawn at any time. Features may be added or removed between versions. Continuing to use the app after an update means you accept the terms in force at that time, which are always the ones published on this page.
8. Governing law
These terms, and any dispute arising out of them or out of your use of Awake, are governed by the laws of the Republic of Uganda, without regard to conflict of law rules. The courts of Uganda have jurisdiction over any such dispute.
If you use Awake as a consumer from outside Uganda, this clause does not deprive you of the protection of any mandatory consumer-protection rule of the country in which you habitually reside, and it does not remove any right you have to bring proceedings in your local courts where the law gives you that right.
